Mediante el recurso que Rorty emplea para argumentar que Heidegger no ha dejado el canon Platón-Kant, vamos a mostrar que el mismo Rorty no puede salir del planteamiento platónico. Para ello nuestro artículo se divide en dos partes principales. En primer lugar, sistematizaremos la inversión de Heidegger que Rorty dejó meramente apuntada en «Overcoming the Tradition: Heidegger and Dewey», rastreando los supuestos ontológicos y epistemológicos en los que el pragmatista se basó para llevar a cabo su peculiar lectura de Heidegger. This article aims to clarify the relationship between the Truth and Justification in the philosophies of Jürgen Habermas and Richard Rorty from their discussions. The thesis that I advocate is that the relationship between Truth and Justification depends on the Ontological and Epistemological assumptions that each maintains and is not a matter of conditions of speech as stated by Habermas.

ABSTRACT The article examines the origin of the rortyan project to destroy Plato's unique image. In his autobiographical writing, Trotsky the Wild Orchids, Rorty describes his philosophical journey and presents his alternative to Plato as thought out from his earliest youth. However, as we will show, the central project of ending Plato's unique image is not something that is thought out or given from the beginning in his works. We argue that, despite what Rorty himself indicated in his writings, we find indications that it is not until the 1990s that Rorty thinks of elaborating a new alternative relationship to Plato's last lexicon. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer (...) a compositional derivation of their meaning. (shrink)

El presente trabajo reconstruye algunas de las tesis centrales de la familia realista-liberal de la democracia en relación con los liderazgos políticos y la participación política de la ciudadanía en sus dos fases de pensamiento: desde el elitismo hacia la poliarquía. Posteriormente se formulan algunas de las críticas que los teóricos deliberativos le realizan a este modelo en relación con el carácter minimalista de la participación y sus dificultades para combatir posibles poderes exógenos a la política. En este sentido, se (...) presentan tres pilares del modelo deliberativo para superar esta aparente debilidad del modelo realista-liberal y generar autonomía política o, al menos, combatir su heteronomía a través de: 1) la transformación de preferencias, 2) el ejercicio de una razón comunicativa, y 3) una fundamentación epistémica de las creencias morales. En este artículo se revisan los avances, los desafíos y las particularidades de la ciencia abierta en la investigación cualitativa. En particular se analiza la apertura de datos porque tiene menor avance en comparación con la publicación en repositorios y revistas de acceso libre. Se revisan los criterios de validez en la investigación cualitativa en ciencias sociales, para identificar algunos elementos que fomenten la apertura de datos, ya que, mientras se plantee como una vía para replicar resultados de investigación, tendrá (...) poco eco en la comunidad que practica la investigación cualitativa. Sin embargo, el artículo muestra que el compartir datos puede fortalecer las estrategias de verificación cualitativa y preservar el conocimiento, las experiencias, las historias y los contextos cotidianos de las personas participantes. Attention-deficit hyperactivity disorder is one of the most common neurodevelopmental disorders in children and adolescents. People who have this disorder are characterized by presenting difficulties in the processes of sustained attention, being very active, and having poor control of their impulses. Despite the high prevalence of this disorder and the existence of various tests used for its diagnosis, few data are available regarding the usefulness and diagnostic validity of these tools. Given the difficulties that these subjects present in executive functions, (...) the aim of this study was to evaluate whether the Neuropsychological Assessment of Executive Functions battery for Children allows to establish specific profiles of executive performance for people with attention-deficit hyperactivity disorder. The sample was made up of 197 participants of both sexes, aged between 6 and 12 years age. A nonexperimental design was followed, using a comparative descriptive study method. The results indicated that the scales of phonological fluency, color path, rings, and interference are the most associated with the diagnosis of ADHD, providing data on inhibition, mental flexibility, sustained and selective attention, planning, verbal fluency, and working memory, among others. The practical implication of these results is in line with providing support in the clinical diagnosis that is carried out in children’s mental health units. In addition, the ENFEN tool can be valued as a suitable psychometric instrument in the psychoeducational field, helping professionals in a school environment to be more aware of the areas of cognitive development in which a student diagnosed with ADHD will have more difficulties and, in doing so, providing more adjusted and effective psychopedagogical measures when it comes to supporting students in their adaptation to the school environment. Aunque estos inicios han sido ampliamente estudiados por liturgistas e historiadores del concilio, el acceso a nuevas fuentes documentales pone a disposición de los investigadores un material que sirve para completar, complementar, enriquecer y abrir nuevas pistas a los trabajos realizados hasta la fecha. Es el caso del archivo personal de Jorge Medina, en el que se encuentran catalogados diversos documentos, los que contienen material relativo, (...) tanto al complejo trayecto de la actuación de la reforma litúrgica como a la primera recepción y aplicación de la constitución Sacrosanctum concilium en Chile. A la luz de esta documentación inédita, este trabajo, que tiene como telón de fondo la publicación del motu proprio Sacram Liturgiam, estudia las propuestas que, en materia litúrgica, el episcopado chileno elevó a la santa sede para poner en marcha la reforma en el país. Resumen En el presente artículo repasaremos someramente algunos de los hitos más reseñables de la historia militar del Imperio Romano Tardío, haciendo hincapié en el papel de los bárbaros que luchaban junto a los romanos, puesto que la barbarización del ejercito romano ha sido uno de los puntos de referencia en las investigaciones acerca de la decadencia y caída del Imperio Romano. En este sentido, haremos referencia al papel integrador que tuvo el ejército romano durante buena parte de la historia (...) del Imperio Romano, y señalaremos los principales hechos que condujeron al final de dicho papel; esbozando también las desastrosas consecuencias que tuvo este hecho para el futuro del Imperio, especialmente del Occidental. In it we will emphasize the role of the barbarians who fought with the Romans, since the barbarización of the Roman army is one of the points of reference in the investigations about the decay and fall of the Roman Empire. In this sense, we will refer to the role played by the Roman army in the integration of foreigners during a large part of the history of the Roman Empire. In addition, we will point out the main events that led to the end of this integrating role; we will also indicate the disastrous consequences this fact had for the future of the Empire, especially for the Western part. The aim of this study was to assess the predictive capacity of some of the most relevant cognitive skills pertaining to the academic field as measured by the Spanish Primary School Aptitude Test Battery. This psychometric tool was applied to all students who were enrolled in the final year of Early Childhood Education in the public schools of the province of Alicante and a follow-up of their academic progress was carried out when they completed Primary Education. The results obtained show (...) that medium-high and high scores in Verbal Aptitude and Numerical Aptitude tests in Early Childhood Education, can predict academic success at the end of Primary Education in instrumental subjects such as: Language and Mathematics. We have determined the importance of developing pedagogical programs that stimulate the development of these skills during Early Childhood Education, while implementing support strategies during Primary Education, for those students who present underdeveloped aptitudes in these areas. In this way, school difficulties would be prevented in the instrumental subjects that provide access to other academic areas. (shrink)

This article reviews the development, challenges, and specificities of open data in qualitative research. Particularly, open data is analyzed because it is relatively less developed as compared to publication in repositories and open access journals. Validity criteria of qualitative research in the social sciences are reviewed in order to identify some of the elements that encourage data openness. As long as data openness is viewed as a way to replicate research results, it’s resonance in the community of qualitative research practitioners (...) will be limited. Nevertheless, the article shows that sharing data might strengthen qualitative verification strategies, as well as preserve the knowledge, experiences, stories, and everyday contexts of the participants. The widely accepted “continuing bonds” model of grief tells us that rather than bereavement necessitating the cessation of one’s relationship with the deceased, very often the relationship continues instead in an adapted form. However, this framework appears to conflict with philosophical approaches that treat reciprocity or mutuality of some form as central to loving relationships. Seemingly the dead cannot be active participants, rendering it puzzling how we should understand claims about continued relationships with them. In this article, we resolve this (...) tension by highlighting two fundamental aspects of paradigmatic loving relationships that can, and often do, continue in an adapted form following bereavement: love and mutual shaping of interests, choices, and self-concepts. Attention to these continuing features of relationships helps to capture and clarify the phenomenological and behavioral features of continuing bonds. However, love and mutual shaping must also change in important ways following bereavement. Love becomes unreciprocated, and although the dead continue to shape our interests, choices, and self-concepts, we predominantly shape their legacies and memories in return. These changes place important constraints upon the nature of our interpersonal connections with the dead. (shrink)

This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. El autor busca reflejar –a partir de la propuesta de Habermas para diferenciar las acciones correctas moralmente- cómo la perspectiva comunicativa puede aportar a los procesos educativos universitarios y cómo ella puede constituir un buen referente para mejorar tanto la eficacia como la corrección moral de éstos. Propone luego un diseño educativo universitario comunicativo que no parta de la coacción, sabiendo que ello exigirá profundas transformaciones personales y sociales.

Ghesmat (roughly could be translated as ‘fate’) is one of the ancient cultural schemas among the Persians. This study explores the schema of ghesmat in the lives of Persian speakers as reflected in their language use among people with different age and educational level. Having introduced the schema of ghesmat in Persian, data was collected by giving a discourse completion test (DCT) to the participants of the study who were randomly chosen. The results of the analysis of data revealed that (...) Persians instantiated the cultural schema of ghesmat in different contextual circumstances of their lives. In addition, the use of this cultural schema was different among people with different age and education. It seemed young educated Persian speakers drew least on the schema whereas old uneducated ones mostly favored ghesmat schema. Finally the study discussed about the possible pattern for the distribution of cultural schemas. (shrink)

When travelling to a new city, we acquire knowledge about its physical terrain, directions, historical facts and aesthetic features. Engaging in tourism practices, such as guided walking tours, provides experiences of a city that are necessarily mediated and partial. This has led scholars in tourism studies, and more recently in philosophy, to question the epistemological value of city tours, critiquingthem as passive, lacking in autonomous agency, and providing misrepresentative experiences of the city. In response, we argue that the mediated and (...) partial knowledge of a city acquired through city tours is not epistemologically disvaluable. Although city tours involve the transmission of testimonial knowledge, this does not necessarily render tourists as passive and non-autonomous. Instead,tourists have the potential to participate in the generation of their knowledge actively. Moreover, we argue that city tours also provide a tourist with valuable ‘objectual’ knowledge of a city, whichhas the potential to be first-personal and active, and does not necessarily misrepresent the city’s identity. This type of knowledge is valuable both for tourists as credible epistemic agents, and for the city itself, as the knowledge generated by the tour can facilitate an accurate representation of the city and promote social transformation. We conclude by highlighting four further epistemic and ethical implications of our argument. (shrink)

We explore a particular type of propagandistic message, which we call “provocative insinuation”. For example: ‘Iraqi refugee is convicted in Germany of raping and murdering teenage girl’. Although this sentence seems to merely report a fact, it also conveys a potentially hateful message about Iraqi refugees. We look at the argumentative roles that these utterances play in public discourse. Specifically, we argue that they implicitly address the question of the integration of refugees and migrants, and in fact aim to tilt (...) the audience against these groups by strongly inviting hearers to make generalisations based on “striking” properties. We examine different strategies to counteract the conveyed hateful message. (shrink)

Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

The stream on political corporate social responsibility argues that companies have recently assumed state-like roles to influence global governance. However, following emerging calls for greater contextualization of CSR, we trace the historic evolution of PCSR in the case of Colombia and argue that such political engagement by firms is not new. Looking beyond a linear chronological account, we reveal the sedimentation process behind PCSR by exploring the archetypical political roles businesses have taken on in providing public goods and acting as (...) regulators, and chart their transformation. Our findings allow us to make two main contributions. First, by unearthing different strata of business and society relations, we enrich the research on PCSR, highlighting its historical sedimentation dynamics. By integrating institutional and historical perspectives, we respond to calls for complementary accounts of one of the premises found in the literature that considers globalization as the starting point of PCSR. Second, our exploration of the past and present of PCSR in Colombia provides scholars and practitioners with an overview of the complex state and stakes of CSR in that country. We also discuss the implications of sedimentation for PCSR theory and future research directions. (shrink)

In spite of this, spontaneous preferences for face or non-face stimuli in lambs have not been reported. In this study we tested the spontaneous preference of 8-day-old lambs (N = 9) for three pairs of stimuli. In each pair, one stimulus was a face-like display, whereas the other presented the same inner features displaced in unnatural (...) positions. One pair of stimuli was obtained from photographic images of ewes’ faces, the other two pairs were schematic face-like stimuli. Lambs could differentiate the two stimuli obtained by photos of conspecifics, looking longer at the non-face stimulus (p < 0.05). We interpret this as a novelty preference, proving that few day-old lambs have already encoded the structural properties that define a face and recognize violations of those general properties. Partiendo de la constatación husserliana de la crisis filosófica como crisis vital de una humanidad que se ha desviado de su _télos_ al implantar el modelo tecno-científico del dominio del mundo, el artículo investiga el lugar de la filosofía en el sistema educativo, explorando las reformas propuestas en Baviera y Prusia por Niethammer y Humboldt a principios del siglo XIX y que plantean, cada una a su modo, la necesaria incorporación de la filosofía a una educación de Estado que, frente (...) a las pretensiones utilitarias del filantropismo, logre elevar al hombre a su humanidad. En este sentido, retorna al concepto humanista de formación (_Bildung_) al que se consagran ambas reformas y que Gadamer recupera precisamente en _Verdad y método_ como un ideal para enfrentar la pretensión de universalidad de la ciencia moderna en relación a las nociones de conocimiento y de verdad, así como para pensar el horizonte ontológico de la experiencia hermenéutica. Es precisamente este ideal el que permite localizar el lugar de la filosofía en el conjunto del saber y conducir al hombre a su humanidad. (shrink)

ABSTRACT My aim in this paper is to present a pluralist thesis about the inferential role of logical constants, which embraces classical, relevant, linear and ordered logic. That is, I defend that a logical constant c has more than one correct inferential role. The thesis depends on a particular interpretation of substructural logics' vocabulary, according to which classical logic captures the literal meaning of logical constants and substructural logics encode a pragmatically enriched sense of those connectives. The paper is divided (...) into four parts: first, I introduce the motivation for the pluralist thesis of the paper; second I introduce the calculus for the different logics endorsed in the pluralist thesis; third, I motivate how the different behaviors of the logical vocabulary of these logics can be pragmatically interpreted, and fourth, I motivate how the different inferential roles that each substructural logic attribute to logical constants can coexist, and how we should reason with a logical constant c given this plurality. ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different participating countries: (...) Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. Después de un breve repaso de un libro de Jorge Wagensberg sobre la experiencia del gozo intelectual, aludo al fenómeno contrario: el pensamiento sombrío y el pesimismo. Después, remarco la defensa de Spinoza del gozo del conocimiento y su poder contra la tristeza y el pesimismo. Finalmente, analizo el peculiar gozo intelectual en Spinoza y conecto este gozo con la experiencia de eternidad y su expresión a través de categorías espaciales.

): This study answers the following question: How does John M. Finnis introduce in his Theory of Law the hartian and razian concept of “an exclusionary reason for action”? The search for an answer entails at least the following items: (a) the generic concept of a “reason for action” and its distinction from other possible motivations for action; (b) the distinctive elements of a legal reason for action, and its difference from other classes of reasons for action; (c) the correlative (...) concepts of authority and obligation, as applied to Law. This analysis will highlight some descriptive and evaluative achievements in Finnis’ proposal, particularly regarding his positivist predecessors, but also some theoretical difficulties, which we presume are linked to Finnis’ aim in trying to conciliate Legal Positivism and Natural Law Theory.Resumen:Este estudio intenta responder a la siguiente pregunta: ¿cómo introduce John M. Finnis en la teoría ius-naturalista del derecho, la idea hartiana y raziana de que el derecho proporciona razones excluyentes para la acción? En la búsqueda de una respuesta se abordarán los siguientes ejes temáticos: (a) el concepto genérico de razón para actuar, y su distinción de otras motivaciones posibles para la acción; (b) los rasgos propios de la razón jurídica para obrar, que la diferencian de otro tipo de razones para la acción; (c) los conceptos correlativos de autoridad y obligación en referencia al derecho. En este análisis se señalarán algunas fortalezas en la propuesta de Finnis con respecto a sus predecesores de la tradición positivista, pero también algunas debilidades descriptivas e inconsistencias teóricas. Estas dificultades se presumen ligadas a la dificultad de Finnis en su intento de conciliar el aparato conceptual heredado de la tradición iuspositivista, con el esquema conceptual heredado de la tradición iusnaturalista y, más ampliamente, con la epistemología práctica tomista que recoge de esta tradición. The claim of this paper is to argue contra Waluchow’s and Raz’s versions of legal positivism – as main representatives of the inclusive and exclusive variants – that legal interpretation always requires an appeal to law’s rea- son or purpose. The main thesis could be expressed as follows: one technique of legal interpretation (the author labels it as systematical), one that demands that the interpreter interprets the law through its general pur- poses in legal practice, is not one technique amongst (...) many, it is necessary in all legal interpretation.The second purpose of the paper is to argue that this systematic approach towards legal interpretation enables an evaluative role on the part of the interpreter that may be called “interpretative creativity”. Due to this, the creative role in legal interpretation is not an exception, but a necessary element in all interpretation. This creative role is not a defect or an inevitable evil in law, but is functional and instrumental to law’s coordinating activity of citizen’s conducts in a reasonable manner.Resumen:Este trabajo se propone mostrar, en contraposición al positivismo jurídico de Wilfrid Waluchow y Joseph Raz —como representantes, respectiva- mente, de la versión incluyente y excluyente del positivismo contemporáneo—, que la interpretación jurídica supone atender siempre, y no de modo excepcional o recortado, a las razones o fines del derecho. La expresión metodológica de esta tesis podría enunciarse diciendo que la interpretación teleológica-sistemática, mediante la cual el intérprete determina el sentido de las normas a la luz de los fines globales de la práctica jurídica, no es un método interpretativo más, sino el modo necesario de toda interpretación jurídica.El segundo propósito de este trabajo es argumentar que la dimensión teleológica sistemática de la interpretación abre un espacio para la valoración por parte del intérprete que podría denominarse, “creatividad interpretativa”. Por esto mismo, la creatividad en la interpretación jurídica no es una excepción, sino una nota general y necesaria de toda interpretación. Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

The flowers of the primitive angiosperm plants were radially symmetrical (actinomorphic). Flowers with bilateral symmetry (zygomorphic) evolved in several clades independently as an adaptation to specialized methods of pollination and played an important role in the diversification of flowering plants. In the model species Antirrhinum majus (snapdragon), the related genes CYCLOIDEA (CYC) and DICHOTOMA (DICH) are key in the development of this trait. This raises the question of whether they played a role in the evolution of floral bilateral symmetry. To (...) address this, the evolution of CYC in relation to the evolution of zygomorphy is being investigated. Phylogenetic and functional analyses of CYC‐like genes are being carried out in groups either closely related to Antirhinum or in families where zygomorphy evolved as an independent event. In addition, the origin of zygomorphy is being studied by comparing the function of CYC‐like genes in species with zygomorphic flowers with their function in species with radially symmetrical flowers. Information from forensic genetic tests of crime scene samples has been used to make claims about suspects' race and appearance. This article discusses and critiques the techniques used to make such claims, and raises policy concerns about them.

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others.
